1. Acceptance of Terms
By creating an account on Fluence Foundationor by accessing or using the platform in any way, you agree to be bound by these Terms of Use (“Terms”) and our Privacy Policy, which is incorporated herein by reference.
Teachers agree to these Terms on behalf of themselves when registering for a teacher account. Students accept these Terms through the account activation flow initiated via their teacher's invite. If you do not agree to these Terms, you may not access or use the platform.
2. Description of Service
Fluence Foundation is a web-based education platform designed for English language teachers and their students. The platform allows teachers to:
- Manage student rosters and track student progress
- Upload PDF materials and add external link or video materials to a library
- Create activities with comprehension questions
- Assign activities to individual students or entire proficiency-level groups
- Review student submissions and provide written feedback
Students can access assigned materials, complete activity questions, and view teacher feedback through their account on the platform.
3. Accounts
- You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
- You must provide accurate, current, and complete information at registration and keep your account information up to date.
- Accounts are personal and may not be shared with, or transferred to, any other person.
- Sessions expire automatically after 8 hours; re-authentication is required to continue using the platform.
- You must notify us immediately at fluencefoundation@gmail.com if you suspect unauthorized access to your account.
4. Teacher Responsibilities
- Teachers are solely responsible for the accuracy of student data (name, email, phone number, proficiency level) they enter into the platform.
- Teachers must obtain all necessary permissions and consents — including parental or guardian consent where applicable — before adding student contact information to the platform, particularly when students are minors.
- Teachers are responsible for complying with applicable data protection laws (including Brazil's LGPD) when processing student personal data through the platform.
- PDF files and other materials uploaded by teachers must not contain content that infringes copyright, violates applicable law, or is otherwise prohibited by these Terms.
- Teachers are responsible for the pedagogical quality and appropriateness of the materials and activities they create and assign.
5. Student Responsibilities
- Students must only access and complete activities that have been assigned to them by their teachers.
- Students are responsible for the accuracy and originality of their submitted answers.
- Students must use the platform solely for its intended educational purpose.
6. Prohibited Uses
You agree not to use Fluence Foundation for any of the following:
- Uploading or distributing malicious code, viruses, or any content designed to harm the platform or its users
- Attempting to circumvent authentication, access controls, or security measures
- Accessing or attempting to access another user's account or data without authorization
- Uploading copyright-infringing materials or content that violates the intellectual property rights of third parties
- Using the platform for any unlawful purpose or in violation of applicable laws or regulations
- Harassing, threatening, or abusing other users of the platform
- Reverse engineering, decompiling, or disassembling any part of the platform software
7. Intellectual Property
The platform's user interface, source code, branding, logos, and all original content created by Fluence Foundation are owned by Fluence Foundation and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the platform solely for its intended educational purpose during the term of your account.
Content uploaded by teachers — including PDF materials, activity questions, and pedagogical notes — remains the intellectual property of the uploading teacher. Fluence Foundation does not claim ownership of teacher-uploaded content. By uploading content to the platform, you grant Fluence Foundation a limited license to store, display, and deliver that content to students you have authorized, solely for the purpose of providing the service.
8. Storage Limits
Teacher accounts are subject to a PDF storage quota. The current quota usage is displayed in the Library section of the platform. Only PDF file uploads consume storage quota — link materials (external URLs) and video materials (YouTube links) do not count toward the storage limit. If you reach your quota, you will need to delete existing PDF materials before uploading new ones.
9. Service Availability
We aim to maintain high availability of Fluence Foundation but do not guarantee uninterrupted or error-free access to the platform. Scheduled maintenance and infrastructure updates may cause brief periods of unavailability. We are not liable for any losses caused by service interruptions.
10. Termination
You may request deletion of your account at any time by contacting us at fluencefoundation@gmail.com. Upon deletion, your personal data will be removed within 30 days in accordance with our Privacy Policy.
We reserve the right to suspend or terminate any account that violates these Terms, engages in prohibited conduct, or poses a security risk to the platform or its users. Where feasible, we will provide notice before taking such action.
11. Limitation of Liability
Fluence Foundationis provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by applicable law, Fluence Foundation and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to data loss, service interruptions, loss of profits, or loss of educational materials, arising from your use of or inability to use the platform, even if we have been advised of the possibility of such damages.
12. Governing Law
These Terms are governed by the laws of Brazil. Disputes arising out of or in connection with these Terms or your use of Fluence Foundation shall be resolved in the courts of Londrina, PR, Brazil.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify registered users via email or an in-app notice, and update the “Last updated” date at the top of this page. Continued use of the platform after changes take effect constitutes your acceptance of the revised Terms.
